The quick answer is as caring people, we want to rescue Lucky, absolutely! That's how I feel.

Rationally, we may accomplish more for our cause if we teach the owner good pet skills and habits. (Maybe do both rescue and teach???)

Thirdly, imperfect as our animal control system is, to some extent, we allow due process to work itself out. We have the opportunity to influence due process in lawful ways. We effect positive change. And we already have :)
